The history of law is in no small part the history of its boundaries. The tendency is best resisted, however, for it mistakenly suggests that only the tools of philosophy, and in practice only the tools of contemporary analytic philosophy, are suited to examining the nature of law itself, as opposed to law in particular places, and as opposed to particular branches of law.

Modern jurisprudence embodies two distinct traditions of thought about the nature of law. The first adopts a scientific approach which assumes that all legal phenomena possess universal characteristics that may be used in the analysis of any type of legal system. The main task of the legal philosopher is to disclose and understand such characteristics,which are thought to be capable of establishment independently of any moral or political values which the law might promote, and of any other context-dependent features of legal systems.

Law is a system of rules created and enforced through social or governmental institutions to regulate behavior, [2] with its precise definition a matter of longstanding debate. Private individuals may create legally binding contracts , including arbitration agreements that adopt alternative ways of resolving disputes to standard court litigation. The creation of laws themselves may be influenced by a constitution , written or tacit, and the rights encoded therein. The law shapes politics , economics , history and society in various ways and serves as a mediator of relations between people. Legal systems vary between countries, with their differences analysed in comparative law.

The word jurisprudence derives from the Latin term juris prudentia, which means "the study, knowledge, or science of law. Legal philosophy has many aspects, but four of them are the most common:. Apart from different types of jurisprudence, different schools of jurisprudence exist. Formalism , or conceptualism, treats law like math or science. Formalists believe that a judge identifies the relevant legal principles, applies them to the facts of a case, and logically deduces a rule that will govern the outcome of the dispute. In contrast, proponents of legal realism believe that most cases before courts present hard questions that judges must resolve by balancing the interests of the parties and ultimately drawing an arbitrary line on one side of the dispute. This line, realists maintain, is drawn according to the political, economic, and psychological inclinations of the judge.

Jurisprudence or Legal Science

It refers to a type of moral theory, as well as to a type of legal theory, but the core claims of the two kinds of theory are logically independent. It does not refer to the laws of nature , the laws that science aims to describe. According to natural law moral theory, the moral standards that govern human behavior are, in some sense, objectively derived from the nature of human beings and the nature of the world. While being logically independent of natural law legal theory, the two theories intersect. However, the majority of the article will focus on natural law legal theory.

Lawyers are typically interested in the question: What is the law on a particular issue? This is always a local question and answers to it are bound to differ according to the specific jurisdiction in which they are asked. In contrast, philosophy of law is interested in the general question: What is Law? This general question about the nature of law presupposes that law is a unique social-political phenomenon, with more or less universal characteristics that can be discerned through philosophical analysis. General jurisprudence, as this philosophical inquiry about the nature of law is called, is meant to be universal.

Views about the nature of law often depend upon, and occasionally have contributed to, answers to some of the most-fundamental philosophical questions—for example, regarding the foundations of morality, justice , and rights ; the nature of human action and intention ; the relations between social practices and values; the nature of knowledge and truth ; and the justification of political rule see political philosophy. The philosophy of law is therefore an integral part of philosophy more generally. Whereas law as a means of governance of human communities dates back to at least bce in ancient Egypt , sustained and systematic philosophical reflection on its nature for which there is surviving evidence began only in the late 5th century bce in ancient Greece and nearby areas of the Mediterranean, not long after the birth of Western philosophy itself. From that point onward, a more or less continuous history of such reflection can be traced up to the present day.
